Civil Liability of Buy Now Pay Later Providers for Harmful Algorithmic Credit Decisions

Abstrak

This study examined the civil liability of Buy Now Pay Later providers for harmful algorithmic credit decisions through normative legal research using statutory, conceptual, and comparative approaches. Automated approval, rejection, limit reduction, or risk classification remained attributable to the bank or finance company operating the product. Liability arose when loss was connected to inaccurate or unlawfully obtained data, an unsuitable affordability assessment, an unvalidated or biased model, inadequate reasons, ineffective human review, or failure to correct an adverse decision. Outsourcing scoring functions did not transfer primary responsibility toward consumers. The study proposed an algorithmic-liability model based on procedural duties, rebuttable evidentiary presumptions, traceable decision records, human reassessment, and restorative remedies. OJK should adopt detailed rules on impact assessment, model validation, fairness testing, explanation standards, audit logs, third-party governance, and time-bound consumer review.
