Integrated Enforcement of Corruption and Bid Rigging in Public Procurement: A KPK-KPPU Collaboration Model

Abstract

Public procurement misconduct may simultaneously constitutecorruption and bid rigging, although Indonesian enforcementcontinues to separate criminal and competition-law dimensions. This study examined the jurisdictional boundaries of theCorruption Eradication Commission and the Indonesia Competition Commission and developed an integratedenforcement model for dual-character cases. Normative legal research employed statutory, conceptual, and case approaches. The study found material differences in protected interests, evidentiary thresholds, procedures, and remedies, while existingcooperation had not comprehensively governed caseclassification, lawful data transfer, enforcement sequencing, orprocedural safeguards. The proposed model combines joint riskscreening, case triage, a lawful data gateway, coordinatedparallel or sequential proceedings, calibrated remedies, andpolicy feedback. It preserves institutional autonomy, reducesduplicated fact-finding, and treats digital procurement indicatorsas early-warning signals rather than conclusive evidence.
